Terms and Conditions

By creating a Pilotlab account you agree to be bound by these Terms and Conditions.

1.1. In these Terms, the following capitalised expressions have the meanings set out below.

  • "Account" means the account created by you in order to access the Services.
  • "Customer Data" means any data, content or material submitted to the Services by you or your Authorised Users.
  • "Services" means the Pilotlab applications, APIs and related services made available at pilotlab.app.

1.2. Headings are for convenience only and do not affect the interpretation of these Terms.

2.1. You must provide accurate registration information and keep it up to date. You are responsible for all activity that occurs under your Account.

2.2. You must promptly notify us of any unauthorised access to or use of your Account.

3.1. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable licence to access and use the Services for your internal business purposes.

3.2. Your use of the Services is additionally subject to our Acceptable Use Policy, which forms part of these Terms.

4.1. Fees for paid plans are set out on our pricing page and are payable in advance unless otherwise agreed in an order form.

4.2. Except where required by law, fees are non-refundable once a billing period has commenced.

4.3. We may revise our fees on not less than thirty (30) days notice, taking effect at your next renewal.

5.1. As between the parties, you retain all right, title and interest in Customer Data.

5.2. You grant us a licence to host, process and transmit Customer Data to the extent necessary to provide the Services.

5.3. Where we process personal data on your behalf, the Data Processing Addendum applies.

6.1. We and our licensors retain all right, title and interest in the Services, including all software, documentation and trade marks.

6.2. Feedback you provide about the Services may be used by us without restriction or obligation to you.

7.1. Each party will protect the other party’s confidential information using at least the degree of care it applies to its own confidential information, and no less than a reasonable degree of care.

8.1. We will use commercially reasonable efforts to make the Services available, excluding planned maintenance and events outside our reasonable control.

8.2. Support channels and target response times for your plan are described in the documentation.

9.1. We may suspend access to the Services where we reasonably believe there is a security risk, a breach of the Acceptable Use Policy, or non-payment of undisputed fees.

10.1. These Terms commence when you first access the Services and continue until terminated in accordance with this clause.

10.2. Either party may terminate for material breach that remains unremedied thirty (30) days after written notice.

10.3. On termination you may export Customer Data for a period of thirty (30) days, after which we may delete it.

11.1. Each party warrants that it has the authority to enter into these Terms.

11.2. Except as expressly stated, the Services are provided on an "as is" basis and we disclaim all implied warranties to the maximum extent permitted by law.

12.1. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence or for fraud.

13.1. You will indemnify us against claims arising from Customer Data or from your use of the Services in breach of these Terms.

14.1. We may update these Terms from time to time. Material changes will be notified at least thirty (30) days before they take effect.

15.1. These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

16.1. These Terms constitute the entire agreement between the parties in respect of their subject matter.

16.2. If any provision is held unenforceable, the remaining provisions continue in full force.
